
Training resources for Paper D of the European qualifying examination
Paper D
The purpose of Paper D is to assess the ability of candidates to answer legal questions and to draft legal assessments.
Paper DI
Paper DI comprises questions relating to different areas of a candidate's knowledge
of the European Patent Convention, the Patent Cooperation Treaty and the Paris
Convention. The duration of the paper is 3 hours and it takes place on the 1st morning
of the exam week.
Paper DII
Paper DII comprises an enquiry from a client requiring an answer in the form of a legal
opinion. Emphasis is on strategic questions rather than formalities. The candidate is
required to analyse the situation and advise the client on how to make the best of his
own patent position and the most favourable position with respect to his competitors.
The duration of Paper DII is 4 hours and it takes place on the 1st afternoon of the exam
week.
(From 2013 both Papers DI and DII will be combined into a single Paper D of 5 hours
duration on the 1st day of the exam week.)
Paper D Resources
There are dedicated areas on EQE-Forum for Paper DI
and Paper DII where candidates can post questions and contribute to
discussions on Paper D in general and on past papers. A tutor is available to answer
questions and to give advice.
The Indexes to the EPO
Guidelines for Examination are in two parts. The first part identifies where in the
Guidelines a particular article, rule, case or the like is referred to, while the second part
is a keyword index. The Indexes only work with the English-language version of the
Guidelines from April 2010.
There is a set of time limit questions to
allow candidates to test themselves on their understanding of time limits under the
European Patent Convention.
We have a quiz of DI-type questions . There are two
sets of questions based on the daily DI questions from 2010/2011. Daily DI questions
will be coming to EQE-Forum again for 2011/2012,
where candidates will have the opportunity to consider a new question each day while
the series is running.
